The Council of Ministers has agreed to resolve, in whole or in part, eighteen appeals for reconsideration lodged against its decision of 21 January 2005, by which the Individualised Allocation of emission rights to the facilities included in the scope of application of Royal Decree-Law 5/2004, of 27 August, was agreed.
This regulation, which regulates the greenhouse gas emission allowance trading system, was approved by the Council of Ministers Agreement of 21 January 2005.
The appeals were filed in due time and form in accordance with the provisions of Articles 116 and 117 of the Law of 26 November 1992, on the legal regime of the Public Administrations and common administrative procedure. The estimate is made at the proposal of the Ministries of Economy and Finance, Industry, Tourism and Trade and the Environment.
Its estimate implies an increase in the total allowances allocated for the period 2005-2007 of 452,607, distributed according to the table attached. This increase will require a readjustment within the margins authorised by the European Commission, so it will not entail a net increase in the allowances available for the 2005-2007 NAP. In any case, the decision of the Council of Ministers shall be notified to the Commission as a modification of the National Allocation Plan.
